Terms and Conditions

Retainers, Deposits, Payments & Taxes

  1. The order is considered “booked” upon receipt of a non-refundable deposit equaling at least 50% of the total value of the cupcakes, delivery charges & equipment deposit.

  2. The final payment is due upon collection of the cupcakes, or for delivery one day prior to the delivery date.

  3. If the cupcakes are booked 7 days or less before the required date, the deposit will equal 70% of the total cost.

  4. If the Client fails to make payments, Cake Me Happy will cease work, the order will be cancelled and no refund will be given.

  5. Preferred methods of payment are bank transfer and cash. If using PayPal, Cake Me Happy reserves the right to charge a nominal fee at cost price, based upon PayPal charges.

  6. The Client will have a grace period of 7 days after the payment date to pay debt before being treated as a late payment.

  7. Late payments will be charged a £10 fee, in addition to the final payment. If payment has not been received within 30 days, Cake Me Happy reserves the right to charge interest on late payments at a rate of 4% above the Santander Base Rate.

 

Liability

  1. Cake Me Happy is not responsible for bodily injury, property or consequential damage, which may result from services.

  2. Cake Me Happy is not responsible for any damage to the cupcakes or shortage of cake caused by anyone NOT employed by Cake Me Happy.

  3. Cake Me Happy will not deliver cupcakes if payments have not been paid in full.

  4. Cake Me Happy’s liability will be limited to 100% of the value of the contract.

 

Fulfillment of Contract

  1. Cake Me Happy is not responsible for any delay or inability to deliver based on accidents, natural disasters, transportation issues, inclement weather, illness, death, labour troubles, delay in supplies, disputes or strikes, pandemic, Government Acts or any other circumstance beyond Cake Me Happy’s control.

  2. If Cake Me Happy has created the order but cannot deliver due to uncontrollable circumstances, the Client will be liable for 30% of the total cost and any funds received over this amount, will be refunded.

  3. If the Client picks up the cake, Cake Me Happy no longer assumes any responsibility for damage caused to it.

 

Postponement/Cancellation

  1. Cake Me Happy reserves the right to charge a discretionary postponement / cancellation fee.

  2. If a cancellation occurs 7 days prior to the required collection / delivery date, all money will be refunded minus the deposit fee.

  3. If a cancellation occurs after 7 days prior to the required collection / delivery date, the full invoice amount remains payable. No refunds will be given.

 

Changes to Order

  1. Any changes must be submitted at least 10 days in advance.

  2. If a change is required and accepted by Cake Me Happy, Cake Me Happy reserves the right to charge a discretionary fee based upon the amount of work involved.

 

Design of the Cake

  1. Cake Me Happy will use its reasonable endeavours to create a cake meeting the client's requirements.

  2. Due to copyright restrictions, Cake Me Happy cannot duplicate an exact copy of another cake artist’s work but will ensure the look is similar.

  3. Cake Me Happy cannot use copyrighted material in the production of its cakes. The Client agrees to fully indemnify Cake Me Happy against any third party copyright claims.

 

Allergy & Dietary Warnings

  1. Cake Me Happy’s baked goods may contain one or more of the following ingredients:

  • Cereals containing gluten

  • Milk

  • Eggs

  • Soy

Cake Me Happy’s baked goods may have come in contact with the following ingredients:

  • Fish

  • Molluscs

  • Sesame seeds

  • Sulphur dioxide

  • Mustard

Full allergen information can be provided upon request.

  1. Due to manufacturing processes and supply-chain constraints, Cake Me Happy cannot guarantee that allergens will not be present in its products.

    • Orders made with allergy or intolerance requirements cannot be fulfilled.

    • Cake Me Happy will not enter into an agreement to provide an allergen free cake.

    • Ingredient free cakes will only be offered when the client has a specific requirement which relates to a lifestyle choice or similar.

  2. Cake Me Happy uses artificial colours and flavourings

  3. A list of ingredients will be provided with each cake; due to manufacturing processes and supply-chain constraints, Cake Me Happy cannot guarantee that allergens will not be present in its products. You should ensure that anyone consuming the cake is made aware of this as we accept no responsibility in the event of an adverse reaction.

 

Ornaments & Special Equipment

  1. A £50 deposit is required for the use of a tiered cake stand.

  2. The equipment must be returned within 7 days of the event.

  3. The returned equipment is evaluated and a refund of the deposit is based on the condition of the items.

  4. All personally supplied items must be submitted to Cake Me Happy at least 10 days prior to the event.

 

Delivery and Set Up

  1. Delivery will be charged at 45p per mile or at a pre-agreed courier rate which will depend upon the mileage.

  2. Cake Me Happy is not responsible for tardiness if the venue is changed within 48 hours of the event.

  3. The Client may pick up the cake.

  4. The Client assumes liability once it passes into the Client’s possession.

  5. The Client must sign a waiver to ensure the condition of the cake is satisfactory.

 

Photographs

Cake Me Happy reserves the right to use all photographs of the cake for advertising purposes.

Cake Contract Agreement

Your cake is very important to us. Please carefully look over the order and cake details to make sure that everything is correct. If you find any mistakes, let us know immediately. By placing an order through us by either means of paying a deposit or payment in full, you are agreeing to the above terms and conditions.
